Councill, Gunnemann & Chally, LLC Files Class Action Lawsuit Against PrizePicks Alleging Its Sports Wagering Products Are Illegal Gambling Under Georgia Law
Suit invokes Georgia statute allowing bettors to recover losses from the winner of a void gambling contract
ATLANTA, GA — August 18, 2026. Attorneys at Councill, Gunnemann & Chally, LLC have filed a proposed class action lawsuit in the Superior Court of Fulton County against SidePrize LLC d/b/a PrizePicks, alleging that PrizePicks’ products, marketed under the names “Pick ‘Em,” “Player Picks,” and “PrizePicks Arena,” are illegal gambling contracts under Georgia law, and that PrizePicks is required to return money it has taken from Georgia customers who lost their wagers.
The case, Wright v. SidePrize LLC d/b/a PrizePicks, Civil Action File No. 26CV011486, was brought by named plaintiff Shareda Wright, a Henry County, Georgia resident, on behalf of herself and a proposed class of Georgians who placed wagers with PrizePicks and lost money doing so.
Sports betting has been illegal in Georgia in one form or another since before the state’s founding, and Georgia’s appellate courts have held for nearly a century that wagers on the outcome of sporting events, including wagers on the statistical performance of individual athletes, are unlawful gambling. The complaint alleges that under Georgia law, contracts formed on such wagers are void, and that money paid on a gambling consideration may be recovered by the loser from the “winner.”
Plaintiff seeks equitable relief on behalf of the proposed class, including restitution, disgorgement, an accounting, and imposition of a constructive trust over funds PrizePicks has collected from Georgia customers’ losing wagers.
CGC is committed to applying what has been the law in Georgia since it became a state: Gambling is against the law and the state’s public policy.
The allegations in the complaint have not been proven, and PrizePicks has not yet responded to the lawsuit.
